COVID-19 Eviction Moratorium

On March 04, 2020 the Governor of the State of California declared a State of Emergency due to the COVID-19 imposing a moratorium on evictions for failure to pay rent due to financial impacts related to COVID-19. The proclamation can be viewed here.

Various Cities and Counties have also declared local emergencies due to the COVID-19 pandemic and adopted an ordinance imposing a moratorium on evictions for failure to pay rent due to financial impacts related to COVID-19 for the period of the local emergency. A TENANT UNABLE TO PAY A PORTION OR ALL RENT DUE BECAUSE OF FINANCIAL IMPACT FROM COVID-19 CAN DO THE FOLLOWING

  • Notify his or her landlord in writing right away of inability to pay rent
  • State the ways in which they have been financially impacted, this can include:
    • Caring for myself or family member who is sick with COVID-19
    • Lay-off, loss of hours, or other income reduction resulting from business closure or other
      economic or employer impacts of COVID-19
    • Compliance with a recommendation from a government health authority to stay home, selfquarantine, or avoid congregating with others during the state of emergency
    • Extraordinary out-of-pocket medical expenses
    • Child care needs arising from school closures related to COVID-19
  • Provide documentation or an explanation, which can include:
    • Proof of being sick with COVID-19 or caring for a household/family member that is sick with COVID-19*
    • Letter, email, texts related to lay-off, loss of hours or other income reduction
    • Health authority communication about recommendation to stay home, self-quarantine, etc.
    • Medical bills
    • Receipts/invoices of child-care costs
    • Explanation from the tenant as to how incoming finances have been impacted by COVID-19 and why tenant is unable to all or part of rent.

*Any medical or financial information provided to the landlord shall be held in confidence and only used for evaluating the tenant's claim.

RENT REPAYMENT

The various City/County local ordinances do not relieve the tenant from eventually paying the rent and some offer a timeframe of repayment anywhere from 6 to 12 months after the expiration of the local emergency moratorium. The landlord may not charge a late fee on the rent. The ordinance is intended to be narrow and no other legal remedies are affected by this ordinance.

How to notify your landlord regarding late rent

We have a blank template to help you notify your landlord regarding your financial situation. This document is not a demand letter, it is a document designed to open official communication between you and your landlord. We have taken the above information and compiled it into an easy to fill out form. Before you venture into using this notice be advised of the following points:

1. To Tenants: If the government says you don’t have to pay your rent and there’s a ban on evictions, you better do whatever you can to pay your rent. There will be major repercussions when eviction bans are lifted. Don’t think you’ll get a free ride out of this.

PAY YOUR RENT! Your landlord has bills to pay too.

3. If the utility company suspends payments, you better pay any amount you can! They are like banks, they will want their money eventually and when all this clears up, you’ll owe an exuberant bill and still won’t have any utilities. Pay whatever you can.

4. If you get a government stimulus check, this check is to help pay your bills. That means you pay your rent, your mortgage, your utilities, your insurance, your car payment, your bills.

This is not for frivolous spending.

5. The real problem is, many who will get the stimulus check....won’t pay their bills while crying and wailing saying

“They evicted me. They cut off my power, they repossessed my car...”

All while digging in their new Gucci purse or walking in that new pair of shoes they bought with their stimulus check.
